Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales, and Computer Employees

AGENCY: Wage and Hour Division, Department of Labor. ACTION: Final rule.

§ 541.600 Amount of salary required.

(a) To qualify as an exempt executive, administrative, or

professional employee under section 13(a)(1) of the Act, an

employee must be compensated on a salary basis at a rate of

not less than $1,128 per week ($58,656 annually for a full-year

employee) exclusive of board, lodging or other facilities, as

provided in § 541.602.

(b) The required amount of salary may be translated into

equivalent amounts for periods longer than one week. Up to ten

percent (10%) of the standard salary level may be satisfied by

nondiscretionary bonuses, incentives, and commissions, that

are paid at least annually, pursuant to § 541.602(a)(3).
